Terms and Conditions

This following user agreement describes the terms and conditions on which PDQ Pickup LLC governs your access to and use of the PDQ Pickup LLC service. These Terms of Use are a legally binding agreement between a User or Driver of the PDQ Pickup LLC service and the PDQ Pickup LLC company. 

Please read these Terms of Use carefully before using the PDQ Pickup LLC service. If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use the PDQ Pickup LLC service.

The PDQ Pickup LLC service is offered and available to users who are 18 years of age or older.

All information we collect on this website is subject to our Privacy Policy.

We may revise and update these Terms of Use from time to time at our sole discretion. All changes are effective immediately when we post them, and apply to all access and use of the PDQ Service thereafter. Your continued use of the PDQ Pickup LLC service following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

You expressly authorize PDQ Pickup LLC service provider, Dwolla, Inc. to originate credit transfers to your financial institution account. You authorize us to collect and share with Dwolla your personal information including full name, email address and financial information, and you are responsible for the accuracy and completeness of that data. DESCRIPTION OF SERVICES

PDQ Pickup LLC is a mobile application platform that connects persons seeking assistance with the relocation, messengering, delivery, or moving of personal items ("Users") with persons who are willing and able to use their vehicle to drive the items and assist the User with the moving and delivery of such personal items to their final destination ("Drivers"). For the purposes of these Terms of Use, these moving services shall hereinafter be referred to as the "Services".

The company does not itself, nor will it provide the transportation or moving services for the Users. Instead, the company connects Users with Drivers, as appropriate. PDQ Pickup LLC offers the pickup service to match Users and Drivers, but does not nor does it intend to provide the services, and, as such, has no liability for any services provided to any User by any Driver using the PDQ Pickup LLC service.

PAYMENTS AND PRICING

All payments are due immediately following the completion of the services and will be facilitated by the company and our third-party payment facilitator using the User’s preferred payment method designated in his or her account.

All payments are non-refundable. In the event that a User cancels a request for service more than five minutes after such a request is made on the PDQ Pickup LLC app, the user will be charged a cancellation fee.

If user cancels their order, a $10 cancellation fee will be automatically assessed and charged to their payment method.

All pricing will be determined by the company at its sole discretion. Furthermore, the company reserves the right to change pricing, including the commission percentage, at any time without advance notice.

REPRESENTATIONS

By using the PDQ Pickup LLC services, you must be the sole authorized user of your account with the company. You are responsible for maintaining the confidentiality of your data, including your password. The company disclaims any and all liability that may arise as the result of the unauthorized use of your account.

REPRESENTATIONS AND WARRANTIES OF DRIVERS

By using the PDQ Pickup LLC service, each Driver represents, warrants, and agrees that: the Driver is at least 21 years old; the Driver has the ability to lift and carry items that may be up to or exceed 50 pounds; the Driver will not permit any User to sit in or ride in the Driver’s vehicle as part of providing the services; the Driver has a valid driver’s license; the Driver will report any and all incidents, claims, or accidents promptly to the company.

EMAIL AND SMS TEXT COMMUNICATIONS

Users and Drivers agree and accept that the company may communicate with Users and Drivers through email and SMS text communications. Such communications are designed for the convenience of the service. If you do not wish to receive any text messages or email communications from the company, you can opt out of such communications by changing the settings in your account page.

TRADEMARKS

The PDQ Pickup LLC name, logo, and all related names, product and service names, slogans, and designs are trademarks of the company. You may not use such marks in any manner whatsoever without the prior written permission of the company.

INDEMNIFICATION

You agree to defend, indemnify, and hold the company, its affiliates, licensors, and service providers, and its and their respective officers, directors, contractors, employees, agents, suppliers, licensors harmless from and against any and all losses, costs, damages, liabilities and expense relating to or arising out of your use of the PDQ Pickup LLC service, including:

• Any violation or alleged violation of law or the rights of a third party (including, among others, Drivers, Users, and other motorists and pedestrians)
• Any damages or losses incurred with respect to the personal items that are the subject of the services.
• Any damages or losses incurred by third parties in connection with or as a result of the performance of the services.

OTHER DISCLAIMERS

The company is not responsible for and does not monitor interactions between Users and Drivers, whether online or in person.

The company is only providing a service of connecting Users and Drivers, and therefore the company has no control over the quality or safety of the services provided by the Drivers.
